Clarke County Overview
Clarke County Sheriff's Office
The Clarke County Sheriff's Office is the main custodian of jail mugshots and arrest records for the county. Sheriff Travis M. Sumption runs the office at 160 N. Church Street, Berryville, VA 22611. The main phone is 540-955-1234. The office is listed in the Virginia Sheriffs' Association directory, the main statewide index for locating the custodian of local booking records.
The sheriff books people into custody, takes the booking photo, and keeps a local arrest log. Mugshots held by the sheriff are public under Virginia Code § 2.2-3706, which requires the release of adult booking photos taken at intake. You can file a written FOIA request for a copy.
Call the office first. Staff can tell you if the person is still in local custody or was moved to the regional jail.

FOIA for Clarke County Booking Records
The Virginia Freedom of Information Act gives you the right to ask for jail records. The sheriff must reply within five working days. File your request in writing. Name the person and give the arrest date if you know it. Ask for the mugshot, the booking sheet, and the arrest report.
Some records may be held back. Under § 2.2-3706.1, criminal incident information has its own rules. Records of people in prison are covered by § 53.1-116. Juvenile records are closed to the public. Keep your request short and clear.
A small fee may apply. The sheriff can charge for copy costs and search time but not more than the real cost.
Note: Under § 19.2-392.2, a sealed or expunged record will not be released by the Clarke County Sheriff.
Clarke County Arrest Procedure
Most Clarke County arrests follow a standard path. An officer makes an arrest, takes the person to the sheriff, and begins the intake. A booking photo is taken. The person is then moved to the Northwestern Regional Adult Detention Center. The booking record is stored by the sheriff and by the jail.
Each booking creates a new file with the charge, the arrest date, and the booking photo. If the charge is a sex offense, the person may be listed under § 9.1-913 in the state sex offender registry. If the record is sealed later, it will not show under § 19.2-392.3.
The Virginia State Police also keep a central criminal history. Only the person who is the subject can ask for their own record. For Clarke County jail mugshots and booking photos, the sheriff is the main office to contact.
